East Bergholt parish council has a won High Court case against Babergh District Council that could impact the future for rural house-building in England and the application of Neighbourhood Plans.

The High Court ruled the district council’s planning decision to allow 10 homes to be built in an Area of Outstanding Natural Beauty, was flawed as it did not take account of the village’s needs – as set out in Babergh District Council’s own local plan. It was also not in line with the emerging Neighbourhood Plan which has since been adopted. The planning permission previously granted is therefore quashed.

SPS has been watching the progress of this case with interest as the judgment will impact on other decisions around Suffolk and is a real test for Neighbourhood Plans.
